Principle and Bylaw Violations

Principle Violated
By the LNC (under "Representative Government")

"We oppose laws that effectively exclude alternative candidates and parties, deny ballot access, gerrymander districts, or deny the voters their right to consider all legitimate alternatives."

Source:
https://www.lp.org/platform

NOTE: The insider bosses kept the LP voters from hearing about all 60+ Prez and VP nominees. Instead of equal time and equal treatment the bosses deleted and censored.

Bylaw Violated
By the LNC (under "ARTICLE 2: PURPOSES Line 2.")

"2. electing Libertarians to public office to move public policy in a libertarian direction."

Source:
https://www.lp.org/wp-content/uploads/2020/03/2018- Indexed-LP-Bylaws-and-Convention-Rules-w-2016-JC-Rules-2.pdf?fbclid=IwAR1amfe-i7UBxNusVeYHlrJghAJ5IDnK03n8nqN2DYgTh7mUAFKTBFpljZI

NOTE: Nobody in America wants a one-party system and that is violation of Article 2, purpose line two, libertarians winning elections. The LNC brings a dictatorship psychology to American voters and nobody buys it because one-party voting systems are no good. That's the LNC violating the purpose of winning by instead guaranteeing losses.

Be it known that James Ogle requests that the LNC Judicial Committee overturn the nominations of Prez and VP.

The LNC shall conduct an election among all nominees for Prez, VP and Electors, all titles simultaneously, 538 names ranked #1 to #538 where each name picks titles starting with #1 who may pick the title US President and/or Chair and the top two ranked names pick first and only President and Vice President may pick a second title such as Chair or Vice Chair.

Paper ballots can use the "party list system" or the blank "write-in paper ballot":

The new "votes of confidence" are described below in item 4., and these new rules allow perpetual votes of confidence for all the executives by each and every one of the 538 Presidential Electors and items of Unity Platform USA, through December 31st 2020.

Violation of Principles

d. voiding of National Committee decisions (Article 7, Section 12),
g. suspension of Presidential and Vice-Presidential candidates (Article 14, Section 5).

Appeal to both LNC Judicial Committee for Following Violations

2012 LP convention Paper ballots using single-winner district plurality voting (or RCV?) using "rounds" = one-party system
2020 LP convention used digital ballots in single-winner election district plurality voting (or RCV?) using "rounds" = one-party system
2020 LP convention didn't allow all names on ballot in Zoom "debates" = censorship of candidates and Delegates have no information about nominees.
2020 LP convention censored close to 60 LP Prez candidates who filed Form Two, fewer than ten spoke in final debate.
2020 LP convention allowed two(?) names for Vice President while all Electors' names were blocked from ballots used in Zoom calls.
2020 LP convention prohibited Prez and VP candidates in the same debate so to demonstrate teamwork and other traits which Delegates might seem appropriate in Zoom call.
2020 LP convention harmed teamwork and cross communication and pair-tests between candidates for Prez and VP.

2020 National Libertarian Party Chair, Vice Chair and all LNC Executive Elections

2020 No proof of paper ballots

Digital ballots using single-winner and multiple-winner districts under plurality and approval (AppV) voting = one-party system

Thresholds for Judicial Committee used pluralities, the top seven vote-getters were winners, and not Droop Quota.

In a seven-winner judicial seat election the Droop Quota could be 12.5% (plus one vote) and satisfaction level 87.5%.

Platform items were voted on using yes/no as options (two-party system).

Chair, Vice Chair, Secretary and Treasurer were elected as single-winner election districts (one-party system).

All Executive seats must be elected at-large as one 16-member (Droop threshold = 5.8% plus one vote) or 17-member (Droop threshold = 5.5% plus one vote) election district.

One-party and two-party voting systems used are unacceptable because America is a melting pot.

The results of blocking/censoring Presidential and Vice Presidential candidates failed the delegates because they didn't know names and messages from all candidates and a large number were kept off the official Zoom Call speaking, voting and ballots.

2) Libertarian Party of California

Our team (Horst/Ogle for Prez/Vice Prez [Libertarian/One]) announced in 2018 as both US Prez/VP, and one as candidate for State at-large CA L.P. Executive, appellate was deleted from California State LP Facebook page and never reinstated and the reason might be censorship(?). Blocked by slate.
2020 CA LP convention made a clerical error kept James Ogle's name off ballot electing delegates
2020 California State LP Convention used paper ballots with multiple-winners under approval voting (AppV) = one-party system for selecting six of twelve qualified Prez and VP candidates including three first-time home-state names and three who flew from East Coast USA, all were present in audience. But they were blocked by quick AppV by Chair.
2020 Paper ballots using 107-winner district plurality voting for LNC Delegates = semi-proportional system so individuals attending were blocked by slate vote.

Bylaw Items #

The 2020 paper ballots were smaller than business card and were destroyed immediately after election results so no second count can be made in 2020. Blocked by the biggest "slate".

The same volunteers might also be part of continually enlargement of censorship and one-party system voting by the "Porcupine Vote Program"(?) being used in LA, CA and USA levels.

The programmers don't use Droop Quota and that snuffing out of competition protects the one-party "insiders".

The United Coalition is resolving this by working with Sarah Revard [Libertarian] so to unite the guidelines of the Los Angeles County Mini-state and the Los Angeles County Libertarian Party within Region 62.

Judicial Committee counted votes incorrectly and refused right to appeal.
Chairperson – David Bowers

After the 2019 LPLAC JC election, the original 34 paper ballots were obtained and kept as proof by appellate, and the copies show that James Ogle's name won 33.33% of votes after the single-transfer of two votes, due to resignation of previous winner of seat.

James Ogle's name won 33.33% of votes on JC as shown from paper ballots cast that same day and now available as proof.

4) Votes on New Rules and New Votes of Confidence
2020 Los Angeles County Mini-state (ss11-9) http://www.allpartysystem.com/e-aps-22-marked.php

Marked Paper Ballot #e-aps-22 by James Ogle on 8/6/2020:

1. Ranked choice voting (RCV): All voting and vote counting shall be in the form of ranked paper ballots only (and eballots when practical and verifiable).

Consecutive numbers beginning with the #s 1, 2, 3, 4, etc. etc. must always be used when marking on (e)ballot of all names and decision-items. Deviation from this guideline #1 will disqualify the ballot, and the ballot will be marked "SPOILED", separated from the stack of ballots with numerical purity and only the pure stack after being separated from the spoiled ballots are considered democratically legit.

2. Election of Names Under Pure Proportional Representation (PPR) - The Election of names are only held in multiple-winner election districts of two or more only using limited voting with no exceptions.

Limited voting using "Xs" brings semi-proportional results and limited voting using ranked choice votes (RCV) brings pure proportional representation (PPR).

Limited voting is used where there are fewer votes cast per voter than there are open seats at-large. By using ranked choice voting (RCV) each paper ballot is one whole vote, one-man-per-vote and each uses the single transferable vote (STV).

There are two equations involved that are used for PPR. First is the Hagenbach-Bishoff Method with the Hare or Droop Quotas and the second is the single transferable vote (STV).

3. Elections of Decision-items - Many decision-items may be ranked simultaneously to save time and that's where each numeral starting with #1 is like one whole vote. Any item attaining 50% plus one vote or more is considered approved "by the team".

In decision-making items, ranked choice voting (RCV) is always used, with no exceptions.

There is no STV when using RCV with decision-items.

In cases of ties, we add the sum of all numerals (or "tics"), and the item(s) in a tie with the lowest sum of rankings gets prioritized above items with larger sums of the rankings. This system is known as "Ogle Method" or "Count the Tics".
